How to use this document
This document should be completed by a person, known as the Affiant, who can attest under oath to their personal knowledge of the circumstances surrounding the marriage. This person could be the other spouse in the marriage or someone who was present at the wedding, like an officiant or close family friend. The document includes information identifying the Affiant, including their name, address, and birth date. The document then goes on to list information describing the wedding, such as the date and location. Finally, the document explains how the Affiant and the subject know each other and the source of the Affiant's personal knowledge about the circumstances surrounding the subject's marriage.
Once the Affiant completes the Affidavit, they should sign it and have it notarized. The subject of the Affidavit should keep the notarized Affidavit in a safe place, such as safety deposit box, so that it is always available to use when they need proof of their marriage.
Applicable law
There are no laws outlining exactly what must be put into an Affidavit of Marriage. There are, however, some generally accepted practices for creating such documents, including making sure the information is robust enough to be persuasive to an authority that the Affiant is qualified to attest to the circumstances surrounding subject's marriage.
